Nuevo Proceso para Promover la Unidad y Estabilidad de las Familias

President Biden recently announced new immigration actions designed to support family unity and stability. Here’s what you need to know:

For Spouses and Children of U.S. Citizens

If you meet the following criteria, you may be eligible for a green card without leaving the U.S.:

  • Residence: Lived in the United States for at least 10 years continuously.
  • Marital/Family Status: Legally married to a U.S. citizen or have a qualifying stepchild relationship with a U.S. citizen.
  • Legal Standing: No significant criminal history and do not pose a threat to national security or public safety.

Parole-in-Place and Employment Authorization

  • Parole-in-Place: May be granted for a one-time period of three years.
  • Employment Authorization: Eligible for up to three years.
  • Green Card Application: Can apply within three years of parole approval.

For College-Educated DACA Recipients and Dreamers

If you are a DACA recipient or Dreamer with a college degree, you may qualify for nonimmigrant status, such as an H-1B visa, under these conditions:

  • Education: Degree from an accredited U.S. institution of higher education.
  • Employment: Offer of employment from a U.S. employer in a field related to your degree.

Important Notes

  • Application Timing: These programs have not yet started. Details will be released by the end of the summer.
  • No Early Applications: Do not submit applications now; they will be rejected.
  • Avoid Fees: Do not pay anyone for application services at this time.

Avoid Fraud

  • Be Cautious: Beware of notarios and consultants promising immediate results or special solutions.
  • Verify Credentials: Always ask for proof of qualifications and keep a copy.
  • Seek Qualified Help: Incorrect advice can jeopardize your chances of staying in the U.S. or obtaining lawful status.

Potential Legal Challenges
This program could face legal challenges, which may affect its implementation. It’s crucial to consult with a knowledgeable attorney to navigate these uncertainties.
